REGULATIONS & GENERAL PURCHASE CONDITIONS

IN THE EUROMETAL S.A. ON-LINE STORE

The on-line store at www.eurometal-magazyn.pl website is owned and administrated by EUROMETAL S.A. that has been inscribed into National Register Court– Enterpreneurs Register by Local Court in Rzeszów, XII Economic Department, KRS No. 0000147414, VAT No. PL 865 22 30 687, REGON No. 831202750, with the company`s seat in 37 – 450 Stalowa Wola, 8 Moscickiego St.

1. The on-line store regulations define rules of submitting an order and selling goods via the internet store (further called Store) owned by EUROMETAL S.A. The internet store sells goods through the internet.

Making an order by a customer is equivalent to accepting all the conditions included in the present regulations.

2. The information on the Store`s website do not constitute an offer accoring to art. 66 Civil Code. It presents the company’s standpoint. The price conditions ought to be treated as confidential.

3. The shopping process can be done by companies only, after previous Customer’s Account creating. Creating as well as owning the account is free of charge. Shopping can be done only by the individuals with granted login and password. Full responsibility for revealing of the password is born by the customer.

4. Orders can be made via the internet - www.eurometal-magazyn.pl as well as by sending:

   • an e – mial - eurometal@eko-swiat.pl

5. Orders can be made at any time of the day. Orders made on week – days after 4pm, on Saturday, Sunday and public holidays will be verified the next working day in the morning hours. EUROMETAL S.A. employees verify the order within one day.

Every order sent to the Store, verified and accepted to realization, will be confirmed in written form by fax or e-mail by EUROMETAL S.A. employees.

6. The primary conditon of order realization is correct filling and sending the order form available during ordering procedure. The order will not be accepted for realization if the form is filled with insufficient or untrue data. We reserve the right to refuse the realization of order, which authenticity is doubtful, for example without contact telephone number, address or e – mail needed to confirm the order.

7. The customer is allowed to make changes in the order during 24 hours after sending it or until the moment of invoicing. The customer cannot cancel the order for goods which have been sent or received.

Making changes in the order requires direct contact with EUROMETAL S.A. employee.

8. The aluminium profiles available through internet sales on web-site are made from 6060 or 6063 alloy. Both of these alloys are alternative. The Customer accepts delivery of aluminium profiles in 6060 or 6063 alloy in moment of place an order. In case of profiles’ delivery requirement made from specific alloy, the Customer should contact with Sales Department in order to confirm specification of aluminium profiles from the storehouse. The alloy’s reservation have to be in order. In case of above unfulfillment the complaint will be refused.

    

   The procedure above is not used for aluminium profiles from another alloys (e.g. 6005A).

    

9. All the prices are netto (22% of VAT should be added), expressed in Polish currency (PLN). The price for every product is binding at the moment of placing the order by the customer. EUROMETAL S.A. reserves the right to change the prices included in the offer, introducing new products to the Store, withdrawing products from the offer, conducting or canceling as well as making changes in the promotions.

10. Every order is VAT invoiced when the ordered goods delivery is ready to be collected or sent.

11. Time needed for order completion ranges from 1 to 14 working days.

In case the goods are not available from stock it is allowed to extend the order realization time. The Seller informs the buyer about the realization time extension.

11. The customer defines the way of delivery during order procedure. All details connected with the delivery are specified during order verification.

When the total quantity of ordered goods exceeds 2.000kg all delivery expanses are covered by EUROMETAL S.A.

12. If there are any defects or nonconformity in delivered goods, the customer is obliged to prepare a protocol at courier’s or deliverer presence as well as inform immidiately EUROMETAL S.A. at tel. numbers +48 34 3281333 or +48 15 6426022 or by e-mail (at eurometal@eko-swiat.pl ).

13. EUROMETAL S.A. does not take any responsibility for orders which cannot be realized due to reasons beyond the company’s responsibility. In case of no ability for completing the order EUROMETAL S.A. will inform the customer at once.

14. EUROMETAL S.A. will do its very best to present the up-to-date offer on the Store website and the goods were accessible for continuous sale. The customer will be immidiately informed by EUROMETAL S.A. in case of price changes or temporary lack of ordered goods and has full right to withdraw the order.

15. EUROMETAL S.A. reserves the right to make changes concerning the sales procedure defined in the these regulations. Any regulations changes become binding starting the moment of being published on the website. Changes do not influence negatively on users` rights or duties for realized orders.

16. All customer account data are confidential and will not be revealed or used for other purposes but direct acount service.

17. All cases which have not been included in these Regulations, are defined by appropriate civil code bylaws and other binding laws.

18. The right organ for adjudging controversial cases previously contracted is the court appropriate for respondent seat or the court appropriate for a place of completion the order.
